I am trying to avoid liability issues this week with a few peaceful days in the Alps. But even after escaping the office, it is hard to switch off.
On the way over the mountain pass to our Austrian chalet I was thinking of the various claims (or potential claims) arising from a mountain slide a few months ago that had blocked the original road and cut the village off from the outside world (force majeure or latent defect in road/tunnel design, planning and construction or, negligence? loss of income, damage to property and personal injury…main contractor, sub-contractor or third party…total aggregate liability…carve-outs for insurance cover?)
Thank goodness, with the valley opening up in front of us the attempted analysis came to an abrupt end. Now I just have the sound of silence and no Sound of Music!
